Digital Competition Law in Europe

Synopsis

The competition law landscape is changing rapidly under pressure of the development of artificial intelligence (AI). Digital technologies, such as software, algorithms and robots, together with big data and machine learning, are developing at such a pace that it sometimes appears impossible to keep up. Accordingly, numerous associated competition law questions, dilemmas and challenges are facing regulators, academics, policymakers, judges, in-house counsel and lawyers. In our daily law practice and academic work, we also increasingly encounter competition by means of (new) digital technologies. It is certain that this trend will continue to grow in the coming years. Many competition authorities are now making digital competition an explicit area of focus. This means that everyone involved in competition law will soon have to tackle the question, if they are not doing so already, as to how the development of digital technologies will impact competition law and what this will mean for his or her practice
