Timely publications by Professor Nanette NEUWAHL

Professor Nanette NEUWAHL, Director of Studies at the Natolin (Warsaw) campus of the College of Europe, has recently published a chapter titled "Les droits et obligations internationaux de l’Union européenne" in Commentaire Mégret sur le droit de l’Union européenne, Relations extérieures, 3rd revised and updated edition, volume titled L’Union européenne comme acteur international, Université Libre de Bruxelles.

      

The chapter, which sets out the international rights and obligations of the Union, allows the reader to assess the complexity of the relationship between the law of the European Union and public international law, for example when it comes to the operation of active or passive international responsibility of the European Union, the functioning of "mixed agreements", the fate of agreements concluded by the Member States, the effect of the European Convention for the Protection of Human Rights and the United Nations Charter, or the applicability to the European Union of peremptive norms of international law.

        

In the same volume, Professeur NEUWAHL has also co-authored with Dr Said HAMMAMOUN of Université de Montréal a chapter on the effects of international law in the EU legal order titled "Les effets des accords internationaux en droit de l’Union".

     

The chapter deals with the effects of international agreements in European Union law. The analysis of a number of recent judgments, including Air Transportation of America, concerning the effect of the Kyoto Protocol in European Union legal order, and Kadi I, which confirms the priority of the fundamental rights of the European Union legal order over a resolution of the UN Security Council, shows that this subject remains very topical even today.
